Terms & Conditions
The Bidder is solely responsible for studying the latest official RFP/NIT, technical qualification requirements, eligibility conditions, corrigenda, amendments and other instructions issued by the concerned Tender Authority and for thoroughly verifying the Generated PDF before submission.
1. General
These Terms & Conditions govern the use of SewaBook Bidder Services provided by E MISHRA TECHNOLOGY ("SewaBook", "we", "us", "our").
By using SewaBook Bidder Services, you ("Bidder", "User", "you" or "your") agree to be legally bound by these Terms & Conditions.
If you do not agree with any part of these Terms & Conditions, you should not use the applicable SewaBook Bidder Services.
2. Nature and Purpose of SewaBook Bidder Services
SewaBook provides technology-enabled document assistance intended to simplify certain activities associated with tender and RFP preparation.
Depending upon the service selected, SewaBook may assist the Bidder with:
- Editing PDF documents;
- Arranging documents;
- Merging multiple PDF documents;
- Combining Bidder-provided documents;
- Organizing documents in a specified sequence;
- Generating or assembling a final PDF;
- Reducing repetitive manual document-processing work;
- Saving time and manual effort; and
- Providing a structured document-processing workflow.
SewaBook's role is limited to providing such technical and document-processing assistance.
SewaBook is not a Tender Inviting Authority, Government Department, Tender Evaluation Committee, statutory authority, certification authority, legal advisor or representative of any Tender Authority.
3. No Guarantee of Tender or PDF Acceptance
SewaBook does not guarantee that any Generated PDF, document, bid, tender submission or application will be:
- Accepted by the concerned Department;
- Accepted by the Tender Inviting Authority;
- Considered technically responsive;
- Considered financially responsive;
- Accepted during technical evaluation;
- Accepted during financial evaluation;
- Considered eligible;
- Accepted due to its format;
- Accepted due to its document sequence;
- Accepted due to its file size;
- Accepted due to electronic upload; or
- Sufficient for satisfying any particular tender condition.
The concerned Tender Authority alone has the authority to determine whether a Bidder and its documents satisfy the applicable tender/RFP requirements.
4. Authority's Final Decision
The decision to accept, reject, qualify, disqualify, shortlist, consider or otherwise evaluate a tender or bid rests solely with the concerned Tender Authority.
SewaBook has no control over the interpretation, scrutiny, verification, evaluation or final decision of any Department or Tender Authority.
5. Bidder's Responsibility to Study the Official RFP
The Bidder must obtain and review the latest information directly from the official website/source of the concerned Department or Tender Authority.
The Bidder should carefully review, wherever applicable:
- Official RFP;
- NIT / Tender Notice;
- Eligibility conditions;
- Technical qualification criteria;
- Financial qualification criteria;
- Experience requirements;
- Turnover requirements;
- Registration requirements;
- GST/PAN requirements;
- EMD requirements;
- Tender fee requirements;
- Security deposit requirements;
- Required certificates;
- Affidavits and declarations;
- Technical specifications;
- Forms and annexures;
- Schedules and checklists;
- Corrigenda;
- Amendments;
- Clarifications; and
- Any other official tender instruction.
6. Verification of Technical Qualification
The Bidder is solely responsible for verifying whether he/she or the concerned Firm/Company satisfies all technical and eligibility requirements specified in the applicable RFP.
The Bidder should independently verify, wherever applicable:
- Minimum experience;
- Similar work experience;
- Number of completed projects;
- Project values;
- Annual turnover;
- Net worth;
- Technical manpower;
- Equipment requirements;
- Registrations;
- Licenses;
- Certifications;
- Technical specifications;
- Mandatory documents;
- Work completion certificates;
- Performance certificates;
- Financial documents;
- Statutory registrations;
- Dates and validity periods;
- Quantities and financial figures; and
- All other qualification criteria.
SewaBook does not independently certify that the Bidder satisfies any technical, financial or eligibility requirement.
7. Mandatory Verification of Generated PDF
Before downloading, uploading, submitting or relying upon a Generated PDF, the Bidder should personally verify:
- Bidder/Firm/Company name;
- Address and contact details;
- PAN and GST details;
- Registration details;
- Tender number;
- Tender title;
- Department/Authority name;
- Important dates;
- Financial figures;
- Technical information;
- Experience details;
- Document numbers;
- Certificate details;
- Annexures and forms;
- Page sequence;
- Signatures;
- Seals/stamps where required;
- Scanned documents;
- Document readability;
- Missing pages;
- Duplicate pages;
- Incorrect pages;
- File order;
- File completeness;
- File size requirements;
- File-format requirements; and
- Any other requirement specified by the latest official RFP.
Successful generation of a PDF through SewaBook does not mean that the PDF is correct, complete or acceptable to the Tender Authority.
8. Comparison With Official RFP and Original Documents
The Bidder should compare the Generated PDF with:
- The latest official RFP/tender document;
- Applicable corrigenda and amendments; and
- The Bidder's original supporting documents.
The Bidder should verify that relevant data appearing in the Generated PDF matches the actual source documents and applicable tender requirements.
9. Source Document Responsibility
The Bidder is solely responsible for ensuring that documents uploaded or selected by the Bidder are:
- Correct;
- Genuine;
- Complete;
- Legible;
- Current;
- Valid;
- Relevant;
- Properly signed where required; and
- Properly stamped/sealed where required.
SewaBook shall not be responsible for errors or omissions originating from documents or information supplied, selected or approved by the Bidder.
10. Corrigenda, Amendments and Changes
Tender requirements may change through corrigenda, amendments, addenda, clarifications or revised tender documents.
The Bidder is solely responsible for checking whether any such changes have been issued by the concerned Tender Authority.
SewaBook does not guarantee that the Platform will automatically identify, obtain, interpret or incorporate every subsequent amendment, corrigendum, clarification or modification issued by any Tender Authority.
11. No Legal, Technical or Tender Advisory
SewaBook's document-processing service should not be considered:
- Legal advice;
- Tender consultancy;
- Chartered Accountancy certification;
- Technical certification;
- Eligibility certification;
- Government authorization; or
- Professional advice concerning Bidder eligibility.
Where the Bidder is uncertain about any tender condition, the Bidder should obtain clarification directly from the concerned Tender Authority or consult an appropriately qualified professional.
12. No Responsibility for Bid Rejection
SewaBook shall not be responsible for rejection, disqualification, non-consideration or non-responsiveness of a Bidder's tender or application arising from or relating to:
- Incorrect information;
- Missing information;
- Missing documents;
- Incorrect documents;
- Expired documents;
- Invalid certificates;
- Incorrect technical information;
- Incorrect financial information;
- Failure to satisfy eligibility criteria;
- Failure to satisfy technical qualification;
- Failure to satisfy financial qualification;
- Incorrect signatures;
- Missing signatures;
- Missing seals or stamps;
- File-size restrictions;
- File-format restrictions;
- Tender portal problems;
- Late submission;
- Failure to submit required fees or EMD;
- Failure to comply with corrigenda or amendments;
- Interpretation of tender conditions by the Authority; or
- Any other requirement imposed by the Tender Authority.
13. Generated PDF is a Tool-Assisted Output
The Bidder understands that a Generated PDF is a tool-assisted document output and is not a certificate of compliance issued by SewaBook.
Generation of a PDF does not mean:
- The Bidder is technically qualified;
- The documents satisfy the RFP;
- The Bidder is eligible;
- The Tender Authority will accept the submission; or
- The tender will be awarded to the Bidder.
It only means that the requested document-processing operation has been performed by the Platform to the extent technically available.
14. Bidder's Final Approval
The Bidder is responsible for performing a final review before using any Generated PDF for an official purpose.
The Bidder should proceed with submission only after satisfying himself or herself that the final document is accurate, complete and compliant with the latest applicable tender requirements.
15. Submission Deadlines
The Bidder is solely responsible for submitting the tender/bid within the deadline prescribed by the Tender Authority.
Use of SewaBook does not extend, modify or protect the Bidder against any submission deadline.
The Bidder should allow sufficient time for final verification, correction, uploading and submission.
16. User-Provided Information
The Bidder represents that information and documents supplied to SewaBook are provided lawfully and that the Bidder has the necessary rights or authority to use such information for the intended purpose.
The Bidder shall not knowingly upload or process:
- Fraudulent documents;
- Forged certificates;
- Falsified records;
- Misleading information;
- Unauthorized documents; or
- Documents belonging to another person/entity without proper authority.
17. Prohibited Use
The Bidder shall not use SewaBook for any unlawful, fraudulent or deceptive purpose.
The Bidder shall not use the Platform to:
- Create fraudulent tender documents;
- Alter documents for deceptive purposes;
- Misrepresent qualifications;
- Fabricate experience;
- Manipulate certificates;
- Falsify financial information;
- Circumvent mandatory tender requirements;
- Impersonate another person or organization; or
- Commit any act prohibited by applicable law.
18. Intellectual Property
The SewaBook software, website design, interface, branding, logos, workflows, code, databases, system architecture and related technology are protected by applicable intellectual property laws.
The Bidder receives only a limited right to use the relevant SewaBook service for its intended purpose.
19. Third-Party Websites and Authorities
SewaBook may refer users to external websites, including official websites of Government Departments, Tender Authorities or other organizations.
SewaBook does not control such external websites.
The Bidder should rely upon the official website/source of the relevant Tender Authority for the latest tender requirements, amendments, corrigenda, notices and submission instructions.
20. Limitation of Liability
To the maximum extent permitted by applicable law, SewaBook and its owners, operators, employees, representatives and service providers shall not be liable for indirect, incidental, special or consequential losses arising from the Bidder's use of the Platform.
Without limiting the foregoing, SewaBook shall not be responsible for losses arising from:
- Tender rejection;
- Tender disqualification;
- Failure to meet eligibility criteria;
- Failure to meet technical qualification;
- Failure to meet financial qualification;
- Incorrect Bidder information;
- Missing or incorrect documents;
- Failure to verify the Generated PDF;
- Failure to follow the official RFP;
- Failure to follow a corrigendum or amendment;
- Failure to meet a deadline;
- Failure to upload documents;
- Government/Tender portal failure;
- Internet or connectivity problems;
- Third-party service failures;
- Digital signature issues; or
- Any decision taken by the Tender Authority.
21. Bidder Indemnification
To the extent permitted by applicable law, the Bidder agrees to indemnify and hold harmless SewaBook, its owners, operators, employees and representatives from claims, losses, liabilities, damages, penalties, costs or expenses arising out of:
- Incorrect information supplied by the Bidder;
- Unauthorized use of documents;
- Fraudulent or forged documents;
- Violation of tender conditions by the Bidder;
- Violation of applicable law;
- Misuse of SewaBook;
- Breach of these Terms & Conditions; or
- Claims arising from the Bidder's submission to a Tender Authority.
22. Service Availability
SewaBook aims to provide reliable services but does not guarantee uninterrupted or error-free availability.
Services may temporarily become unavailable because of maintenance, software updates, network failures, server issues, security incidents, third-party service failures or circumstances beyond reasonable control.
23. Payment for Services
Where a particular SewaBook service requires payment, the applicable service fee shall be displayed before or during the relevant transaction.
Payment for a document-processing service constitutes payment for the applicable service and does not constitute any guarantee of tender acceptance, qualification, approval or successful bidding.
Any applicable refund or cancellation shall be governed by the applicable SewaBook Refund/Cancellation Policy.
24. No Agency or Representation
Use of SewaBook does not create any agency relationship, partnership, joint venture, employment relationship or Government authorization between the Bidder and SewaBook.
Unless separately agreed in writing, SewaBook acts only as a technology and document-processing service provider.
25. Hierarchy of Documents
In the event of any conflict between:
- Information displayed on SewaBook;
- Information entered by the Bidder;
- A Generated PDF;
- An older tender document; and
- The latest official RFP/corrigendum issued by the Tender Authority;
26. Claims Relating to Bidder's Failure to Verify
Where a Bidder has received, downloaded, previewed or otherwise obtained a Generated PDF and fails to conduct the recommended final verification before submission, SewaBook shall not be responsible for claims arising solely from errors, omissions, incorrect information or non-compliance that could reasonably have been identified through such verification.
The Bidder's failure to review the final Generated PDF shall not transfer the Bidder's responsibility for the tender submission to SewaBook.
27. Modification of Terms
SewaBook may modify, update or revise these Terms & Conditions from time to time.
The updated Terms & Conditions shall become applicable from the effective date stated on the Platform.
Where a new Terms version is introduced, users may be required to accept the updated version before continuing to use applicable Bidder Services.
28. Governing Law
These Terms & Conditions shall be governed by and interpreted in accordance with the applicable laws of India.
29. Jurisdiction
Subject to applicable law, disputes arising directly between the Bidder and SewaBook concerning the use of SewaBook Services shall be subject to the jurisdiction of the competent courts having jurisdiction over the principal or registered office of E MISHRA TECHNOLOGY.
Applicable jurisdiction shall be determined in accordance with the actual registered/principal office details of E MISHRA TECHNOLOGY and applicable law.
30. Severability
If any provision of these Terms & Conditions is determined to be invalid, unlawful or unenforceable by a competent authority, such provision shall be modified or severed to the minimum extent necessary, and the remaining provisions shall continue to remain effective to the extent permitted by law.
31. Entire Agreement
These Terms & Conditions, together with the applicable Privacy Policy, Refund/Cancellation Policy and other policies expressly incorporated by reference, constitute the terms governing the Bidder's use of the applicable SewaBook Bidder Services.
32. Important Final Disclaimer
SEWABOOK IS A DOCUMENT-PROCESSING AND TECHNOLOGY-ASSISTANCE PLATFORM.
It is intended to minimize the Bidder's manual effort in editing, organizing and merging documents and to help reduce repetitive work, time and manual processing errors.
SEWABOOK DOES NOT GUARANTEE THAT ANY GENERATED PDF, DOCUMENT OR BID WILL BE ACCEPTED, APPROVED, QUALIFIED, SHORTLISTED OR CONSIDERED RESPONSIVE BY ANY GOVERNMENT DEPARTMENT, TENDER AUTHORITY OR OTHER AUTHORITY.
The Bidder is solely responsible for studying the latest official RFP, NIT, corrigenda, amendments and other official documents; verifying all technical and financial qualification requirements; matching relevant data with the Generated PDF; checking every page and document for errors or omissions; and ensuring compliance with all applicable requirements before submission.
The final decision regarding acceptance, eligibility, technical qualification, financial qualification and award of any tender rests solely with the concerned Tender Authority.
33. Bidder Acceptance
Acceptance of Terms
By registering, accessing, purchasing, generating a document or otherwise using SewaBook Bidder Services, the Bidder confirms that he/she has read, understood and agreed to these Terms & Conditions.
The Bidder acknowledges that SewaBook's services are intended to assist with document processing and do not constitute a guarantee of tender acceptance, qualification or approval.
A Bidder's acceptance of the applicable Terms & Conditions version shall be treated as acceptance of the Terms governing the use of the applicable SewaBook Bidder Services.
